The loophole in one paragraph
The 2018 Farm Bill defines hemp as Cannabis sativa L. with a delta-9 THC concentration of no more than 0.3% on a dry weight basis. THCA flower is cannabis flower with little delta-9 THC and a large amount of THCA, the acid form of delta-9 THC. A lab that measures delta-9 THC alone can report a number under 0.3%. The flower then moves as hemp. Heat changes that. Smoke or vape the flower and THCA loses a carboxyl group and becomes delta-9 THC.

THCA and delta-9 THC are different molecules
THCA (tetrahydrocannabinolic acid) carries an extra carboxyl group. In raw flower it does not produce the effect that delta-9 THC produces. Decarboxylation starts at about 220 F. Time and temperature both matter. A joint, a vape at 350 F, and an oven at 240 F convert THCA at different rates. The label on the jar describes the raw plant, not the smoke.

How a batch tests under 0.3%
USDA rules require hemp to be tested for delta-9 THC. The rules do not require a lab to count THCA in that number. High-performance liquid chromatography (HPLC) separates the cannabinoids and does not heat the sample. Gas chromatography heats the sample, so THCA converts inside the machine and the readout includes the new delta-9 THC. A grower who wants a passing report sends the sample to a lab that uses HPLC and reports delta-9 THC on its own. Several state hemp plans require total THC instead, which counts THCA after conversion. Some states also allow a margin for lab measurement error on top of the 0.3% limit.

Where the rule stops
State law decides if a store can sell THCA flower. Some states have banned hemp-derived intoxicants or named THCA in statute. Enforcement differs from state to state and from county to county. The DEA has issued letters on THCA, and case law on the point is thin. A batch that tests above 0.3% delta-9 THC, or a test method a state rejects, can turn the same jar into a controlled substance.
Questions to ask before you buy
- Which lab ran the test, and what method did it use?
- Does the report list delta-9 THC alone, or total THC after decarboxylation?
- Has this state banned THCA or hemp-derived THC?
- What is the return policy if the product does not match the label?
- Is the jar sold as hemp or as state-licensed cannabis?
A hemp shop and a licensed dispensary can sell the same strain under different rules. Ask for the COA, read the delta-9 THC number, and check your state law before you pay.
